Terms of use

1. Purpose of the service

Webopolis is a browsable 3D city where each building represents a brand. Each brand has a storefront (a whole building, customisable on each of its façades) that links to its own website for sales; Webopolis does not host or process any commercial transaction between a brand and its customers.

2. Access conditions

Browsing the city is open to everyone, with no account required. Creating a brand account (to get a facade) requires the legal capacity to enter into a contract and, for an individual, being of legal age or having the authorisation of a legal guardian.

3. User account

Creating a brand account requires a valid, verified email address. You are solely responsible for keeping your credentials confidential and for any activity carried out from your account. Notify us without delay at [email protected] if you suspect unauthorised use.

Webopolis may suspend or delete an account in the event of a breach of these Terms, proven fraud, non-payment (see the Terms of Sale), or prolonged inactivity on an unverified account.

4. Prohibited behaviour

• Publishing or linking a facade to illegal, misleading or fraudulent content (including phishing or impersonating another brand).
• Infringing the intellectual property, privacy or image rights of third parties.
• Attempting to bypass the identity or domain verification checks put in place by Webopolis.
• Disrupting the operation of the site (intrusion, large-scale automated scraping, deliberate server overload).
• Creating an account on behalf of a brand you are not authorised to represent.

5. Suspension and moderation

A facade may be temporarily hidden from the city, without this amounting to termination, while we look into a report or a serious indication of impersonation, trademark infringement, or an infringement of a third party's rights. Except in obvious cases (active fraudulent content, blatant impersonation), the brand concerned is notified and given the opportunity to respond before any final decision.

By creating an account, you authorise Webopolis to automatically visit the home page of the website you declare (and only that page), at sign-up and at regular intervals, to check that it matches your business and does not contain fraudulent content (phishing, collection of credentials or banking data). These visits are made by an identified bot (WebopolisBot). A discrepancy may lead to a review by our team and, in clear-cut cases, to your facade being temporarily hidden while we wait for your reply.

If the review confirms a breach of these Terms of Use, Webopolis may suspend or terminate the facade concerned on that basis, with no refund for amounts already paid for the period concerned. If the report turns out to be unfounded, the facade becomes visible again with no further consequence.

This process does not prevent Webopolis from immediately removing manifestly unlawful content, in line with its status as a hosting provider (article 6 of French law n° 2004-575 of 21 June 2004).

6. Intellectual property

The code, design and "Webopolis" trademark belong to the publisher. Content a brand uploads (logo, visuals, facade copy) remains its property; by publishing it on Webopolis, the brand grants us the right to display and distribute it within the city for as long as its subscription remains active.

7. Liability and availability

Webopolis uses reasonable means to keep the site available and secure, without guaranteeing uninterrupted or error-free operation. The site may be temporarily unavailable for maintenance.

Webopolis is not a party to transactions between a brand and its customers, and cannot be held liable for the content, products or services offered by brands on their own sites.

8. Links to third-party sites

Facades and storefronts link to sites operated by the brands themselves, outside Webopolis's control. We carry out identity checks (see our Safety & trust page) but cannot guarantee the content, availability or practices of these third-party sites. Before submitting personal or banking information, always check that you are on the brand's official site.

9. Changes to these Terms

Webopolis may update these Terms of Use, in particular to reflect changes to the service or to the law. Brands with an active account will be notified by email of any material change, with reasonable notice before it takes effect.

10. Governing law and jurisdiction

These Terms of Use are governed by French law. Failing an amicable resolution, any dispute falls under the jurisdiction of the courts local to the publisher's registered address.
